"We are exploring and mobilizing all options to bring the crew back safely," an OceanGate spokesperson said in an email to CTV News. "Our entire focus is on the crewmembers in the submersible and their families."


Those tours are a series of five eight-day missions to the Titanic with the money raised by tourists going towards Titanic research. Posts on social media show the ship launched from the St. John's area last week.

You are correct. You cannot sign away your own negligence. The interview with Cameron posted earlier was instructive. He's done 33 dives to the Titanic. He and Dr. Ballard would be a devastating combination to show that while submersibles are admittedly dangerous, there are numerous ways to mitigate that risk. It sounds like OceanGate did not avail themselves of those ways. Further, they were put on notice in at least 2018, based upon prior reporting regarding an employment lawsuit. I also understand that there were other documented occasions in which the submersible did not perform as anticipated/expected. All of that means that the company was on notice about problems with their equipment and they cannot sign away their own liability.

Now if the sub were proven to have been eaten by a megalodon, well, they would be out of luck. That's the kind of risk that the sub company could not reasonably anticipate and that passengers should be aware could (emphasis on could - I know it's a movie/joke) happen.
