I'm assuming they checked to make sure the magazine was empty by that time so why separate the two? I don't think the police are that dumb.

I’m not sure we can see enough of the rifle to know that for certain. There are bags actually designed for “fast” deployment of short barreled rifles. That doesn’t look like such a bag but, it doesn’t mean that it is certainly too small to hold an SBR, and that the rifle in the picture isn’t an SBR.
