Because in most states its absolutely a crime. It's essentially an aggravating factor (leveraging a position of authority) in what would otherwise be a legal tryst.
It's a crime because...it is. It's codified by law.
If you think that should be changed, by all means, contact your congressmen. Good luck getting him/her to sponsor "HB 1401: The Let Teachers Fuck Their Students Act"....

Well the students rights arent technically being infringed; I don't think they'd really have standing. I suppose the teachers could give it a shot but the Constitution gives states the right to pass laws designed to regulate public health, safety and welfare.
So unless you believe that completely unfettered sexual access is a fundamental right, you're probably hosed. Hell, even if you think it is, laws preventing teachers from nailing their students would almost certainly pass a strict scrutiny test.
There might be a makeable 14th Amendment/equal protection style challenge there; kinda depends on the law in question.

There has to be a line. If in your state a girl is 17 years and 364 days old and has sex with a 30 year old he goes to jail assuming that state has a consent age of 18. Where as a girl who is 17 years and 366 days old has sex with a 55 year old man and it isn’t a crime.
I think that kids grow up more in their first 3 weeks of college than they do in their last two years of high school which is why I’d make the HS teacher/student a crime.
Of course it isn’t 100% perfect, but in my extremely limited educational opinion on the subject that is where the line should be drawn. [Reply]
